Terms of Service

1. Introduction and Acceptance

By using the Real Estate CRM platform, provided by Jans Trade, LLC ("Company", "Service", "We"), you agree to these Terms of Service. If you do not agree to these terms, please do not use the platform.

These terms apply to all features, services, and content of the platform, including both free and paid subscription plans.

2. Service Description

Real Estate CRM is a Software-as-a-Service (SaaS) platform designed for real estate professionals. The platform provides tools for:

• Property management and listing tracking
• Owner and tenant relationship management
• Rental contract creation and digital management
• Automated reminders for payments and contract renewals
• Financial transaction logging and basic reporting
• Calendar and appointment scheduling

The Service is provided on a subscription basis. We may update, modify, or discontinue specific features of the Platform at any time to improve the service.

3. Account Registration and Security

You must create an account to use the platform. When creating an account:

• You must provide accurate, current, and complete information.
• You must keep your account information secure and not share your login credentials.
• You are responsible for all activities that occur under your account.
• You must immediately notify us if you suspect any unauthorized access to your account.

4. Subscriptions, Payments, and Billing

4.1. Free Trial

We offer a 14-day free trial to new users upon account creation. No credit card is required to start the trial. During this period, you will have access to the Platform's core features to evaluate the service. At the end of the 14-day trial, your access to the Service will be restricted or suspended unless you upgrade to a paid subscription plan.

4.2. Subscription Plans

To continue using the Platform after the trial period, you must select a valid subscription plan (e.g., Monthly or Yearly). By subscribing, you agree to pay the fees indicated for your chosen plan. All fees are exclusive of applicable taxes, levies, or duties imposed by taxing authorities, unless stated otherwise.

4.3. Automatic Renewal

Subscriptions renew automatically at the end of each billing cycle (month or year, depending on your plan) unless canceled. The renewal fee will be charged to the payment method on file. You authorize us to collect the applicable subscription fee for each renewal term.

4.4. Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team. Your cancellation will take effect at the end of the current paid billing period. You will retain access to the Service until your current subscription period expires.

4.5. Refunds

Payments are generally non-refundable, except where required by applicable law. We do not provide refunds or credits for partially used subscription periods (e.g., if you cancel halfway through a month).

4.6. Pricing Changes

We reserve the right to modify our pricing and plans. Any price changes will be communicated to you in advance (e.g., via email or distinct notice within the Service) and will apply to the start of your next billing cycle. Continued use of the Service after the price change constitutes your agreement to pay the new amount.

5. User Obligations

When using the platform, you must comply with the following rules:

• Comply with all applicable local, state, national, and international laws and regulations.
• Respect the privacy and rights of others (including your tenants and landlords).
• Do not enter false or misleading information into the system.
• Do not misuse or harm the platform infrastructure.
• Do not provide unauthorized access to others' data.

6. Prohibited Activities

The following activities are strictly prohibited:

• Violating platform security or gaining unauthorized access to systems.
• Attempting to probe, scan, or test the vulnerability of the system.
• Using automated systems (bots, crawlers) to access the Service without permission.
• Infringing copyright, trademark, or other intellectual property rights.
• Engaging in illegal activities, including fraud or money laundering.

7. Intellectual Property Rights

The platform and its content (software, design, text, graphics, logos) are owned by Jans Trade, LLC and protected by copyright and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform solely for your internal business purposes.

You retain ownership of the data and content you upload to the platform ("User Data"). However, you grant us a worldwide, royalty-free license to use, host, store, and modify such User Data insofar as is necessary to operate, improve, and provide the Service to you.

8. Data and Privacy

For detailed information about how we collect, use, store, and protect your data, please review our Privacy Policy. By using the Service, you agree to the data practices described therein.

9. Service Availability

We provide the platform "as is" and "as available". While we aim for high uptime, we do not guarantee that the service will be uninterrupted, error-free, or secure at all times. The service may be temporarily unavailable due to maintenance, updates, or technical issues.

10. Limitation of Liability

To the extent permitted by applicable law:

• We are not liable for direct, indirect, special, incidental, or consequential damages arising from the use or inability to use the platform.
• We are not liable for data loss, profit loss, business interruption, or other commercial damages.
• Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid us for the Service in the 12 months preceding the claim.

11. Account Termination

We may suspend or terminate your account (and access to the Service) without prior notice if:

• You violate these Terms of Service.
• You fail to pay subscription fees when due.
• You engage in illegal or fraudulent activities.
• Your account remains inactive for an extended period (for free accounts).

You can cancel your account at any time. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We may update these Terms of Service from time to time. For significant changes, we will notify you via email or in-platform notification. Changes are effective from the date of publication. Your continued use of the platform after the effective date constitutes your acceptance of the changes.

13. Governing Law and Territorial Scope

These Terms of Service are governed by the laws of the Republic of Turkey. Disputes arising from these terms will be resolved in Turkish courts.

Territorial Scope: The Platform is operated by a US entity. It is offered to real estate professionals worldwide, including users in the EU and other regions. However, by using the Platform, you acknowledge that you are doing so on your own initiative and are responsible for compliance with any local laws applicable in your jurisdiction.
